Целью данного исследования является анализ процесса формирования норм международного права обычного характера в современных реалиях с уделением особенного внимания концепции настойчиво возражающего государства.
Для выполнения данной цели автором были поставлены следующие
задачи:
- изучить ключевые вопросы относительно «всеобщей практики»;
- рассмотреть альтернативные теоретические позиции относительно роли opinio juris и выявить главенствующие виды доказательств opinio juris;
- изложить суть нормы о «настойчиво возражающем государстве» и пределы ее действия.
Объектом данного исследования выступает процесс обычного нормообразования в международном публичном праве на современном этапе.
В предмет данного исследования входят нормативные и доктринальные источники, которые затрагивают процесс обычного нормообразования в международном праве, а также релевантные решения органов международного правосудия.
